Advertencia de sanciones por concentración ilegal de ‘tuning’ en Alcorcón

The Alcorcón City Council has warned of the possible imposition of «serious sanctions» on the promoters and participants of a new illegal vehicle gathering that took place last Saturday in the commercial area of Parque Oeste, also warning the responsible parties of this space.

This unauthorized gathering, which brought together numerous ‘tuning’ vehicles and attendees, «generated loud noises incompatible with the permitted limits and affected the rest of the neighbors», which could constitute a violation of the municipal regulations on noise pollution«, as reported by the City Council.

This is not the first time that such a gathering has occurred in Parque Oeste, since on January 18th, thousands of vehicles already congested the streets of this commercial space with loud music, drinking, and accumulated trash, which had already sparked protests from many of the area’s residents.

Therefore, faced with this new gathering, the Department of Environment has decided to take action and has initiated an administrative procedure to assess the opening of a disciplinary proceeding against the organizers and participants of the illegal gathering.

In this regard, in compliance with the Noise Pollution Protection Ordinance and the provisions of Article 63 of Law 39/2015, on Common Administrative Procedure, they are collecting the necessary reports and evidence to potentially initiate a disciplinary proceeding.

The City Council warns that actions could be taken against both the direct responsible parties for the sound emissions – the drivers of the vehicles involved – and against «those with management or control responsibilities over the affected space», the parking lot of the commercial area, in this case.

In this sense, actions will be taken against these responsible parties «whenever it is determined that, with effective intervention capacity, they did not take the necessary measures to prevent the improper use of the facilities«, as explained by the councilor of the area, Trinidad Castillo (Más Madrid).

«The right to rest is above the irresponsibility of a few, and those with effective capacity over the use of these spaces who did not act to prevent these gatherings must take their share of responsibility,» added the councilor.

Castillo has emphasized that they will use «all legal tools» at their disposal and will act «firmly to ensure peace and quality of life in our neighborhoods».

Thus, if a very serious violation is confirmed – such as conducting activities without a license or exceeding authorized noise levels – the Ordinance provides for fines of up to 6,010.12 euros, and measures such as the temporary closure of the space for up to 4 years.

On the other hand, serious violations may result in fines of up to 3,005.06 euros and the suspension of activities for a maximum of 2 years.

«This type of phenomenon requires a comprehensive response, coordinated with other municipal areas. For example, the establishment of control checkpoints at the municipality entrances to deter the entry of vehicles that, in many cases, circulate without inspection or exceed legal noise emission limits,» added the City Council.

However, they also focus on «those who allow – even by omission – these gatherings to take place on their private spaces», who «must assume their share of responsibility, both institutionally and legally», so «the City Council will not turn a blind eye».

Finally, the City Council has called for citizen collaboration to address this type of uncivil behavior, inviting neighbors to submit any available evidence – such as audiovisual material, photographs, or testimonies – that can document and drive the corresponding administrative actions.
